Judge Mulley was first elected Penfield Town Justice in November 2009. Judge Mulley has been an active member of the Monroe County Magistrates Association since his election, serving as President of the Association for two years.

Judge Mulley is a former member of the Penfield Town Council. He was elected to the Town Council in 2005, re-elected in 2007, and named Deputy Supervisor in 2008. As a councilman, he chaired the Town's Law and Finance Committee.

In addition to elected office, Judge Mulley has held numerous positions in State and County government. He was employed as Executive Assistant, New York State Supreme Court, Appellate Division, Fourth Department, assisting the Presiding Justice in the management of court activities in a twenty-two county region. Before that he served as Special Counsel to the Monroe County Executive, Acting Monroe County Public Safety Director, and as a law clerk in NYS Supreme Court. Judge Mulley is also an experienced trial attorney, having worked as Supervising Attorney in the Monroe County Juvenile Prosecutor's Office and as a Special Assistant in the Monroe County Public Defender's Office. He served on several regional councils, including the Juvenile Justice Council, the Criminal Justice Council, the Board of Visitors at Industry and the Stop DWI Technical Advisory Board.

Judge Mulley earned his undergraduate degree from St. John Fisher College and his law degree from the State University of New York at Buffalo. He was an Adjunct Professor at Rochester Institute of Technology for more than twenty years, teaching criminal law and juvenile justice courses to undergraduate students in the criminal justice program.
